Should Domestic Partners Be Entitled To Spousal Support? Melissa Etheridge vs. Tammy Michaels

Melissa Etheridge is a well known rock singer/songwriter and musician who came out publicly came out in January 1993 ad has since become an “iconic gay and lesbian activist” as stated by Wikipedia. Melissa became engaged to Tammy Lynn Michaels in April 2003 who is an American actress . They had a “commitment ceremony” in September 2003.
The couple has since had twin children in 2006, after Tammy was artificially inseminated with the sperm of an anonymous donor. The twins were born in October 2006, they had both a son and daughter. In October 2008 the couple announced their plans to get legally married. Things didn’t goes as planned when California passed Proposition 8 which banned same-sex marriage.
In April 2010 rumors spread of the couple splitting up and now they have both filed legal documents with the court to finalize their split. Only issue is they can’t seem to agree with anything even the fact of whether or not they were legally married. Tammy is claiming they were married giving her the right to file for spousal support. Melissa is stating however, that they were never officially married since they only had a commitment ceremony.
After spending numerous years together and two children does Tammy deserve to receive spousal support?
